การซื้อขายอาวุธปืนโดยผู้ซื้อชำระเงินให้แก่ผู้ขาย และผู้ขายส่งมอบอาวุธปืน พร้อมใบ ป.4 ซึ่งผู้ขายได้ลงลายมือชื่อของผู้ขายเอาไว้ด้านหลัง และเอกสารที่เกี่ยวข้องกับการโอนของผู้ขายเช่น สำเนาบัตรประชาชน สำเนาทะเบียนบ้าน ฯลฯ เพื่อให้ผู้ซื้อนำไปดำเนินการโอนทางทะเบียนต่อนายทะเบียนอาวุธปืนเอาเอง โดยผู้ซื้อและผู้ขายไม่ได้ไปดำเนินการโอนต่อหน้านายทะเบียนในขณะที่มีการซื้อขาย การซื้อขายอาวุธปืนโดยการโอนลอย หากผู้ซื้อมีใบอนุญาตให้ซื้อหรือรับโอนอาวุธปืน ( ใบ ป. 3 ) ในขณะที่มีการซื้อขายโดยการโอนลอย ก็ไม่มีปัญหา แต่อาจเกิดปัญหาได้ หากการซื้อขายอาวุธปืนโดยการโอนลอยให้แก่ผู้ซื้อซึ่งในขณะทำการซื้อขายผู้ซื้อยังไม่ได้รับอนุญาตจากนายทะเบียนให้ซื้อหรือรับโอนอาวุธปืน คือไม่มีใบ ป. 3 ( ถึงแม้ผู้ซื้อจะไปดำเนินการขอใบ ป. 3 ในภายหลังก็ตาม ) และมีผู้มาพบการกระทำความผิด ผู้ขายก็จะมีความผิดฐานโอนหรือขายอาวุธปืนให้แก่ผู้ที่ไม่ได้รับอนุญาตตามพระราชบัญญัติอาวุธปืนฯ มาตรา 59 ส่วนผู้ซื้อก็จะมีความผิดฐานซื้อ หรือมีอาวุธปืนโดยไม่ได้รับอนุญาตตามพระราชบัญญัติอาวุธปืนฯ มาตรา 7 บางครั้งการโอนลอยก็มีประโยชน์ในเรื่องของความสะดวก ซึ่งก็เป็นที่นิยมใช้วิธีนี้กัน แต่บางครั้งก็อาจสร้างปัญหาตามมา หากไม่รอบคอบและไปกระทำผิดกฎหมายเข้าครับ เพราะฉะนั้นควรขายปืนกันแบบสบายใจทั้ง 2 ฝ่ายคือการตัดโอนกันที่อำเภอจะดีที่สุด
